1.1. - These General Terms and Conditions of Sale (GTCS) regulate the purchase, via electronic means or by telephone, of the goods (hereinafter "Products") presented on the website www.musiczoneshop.it (hereinafter "Website"), between Music Zone Strumenti Musicali, Via Milano, 19 - 92026 Favara, AGRIGENTO PI 02768070845, and its users/customers (hereinafter "Customers"), intended as natural or legal persons acting in the exercise of their entrepreneurial or professional activity, or their intermediaries, constituting an integral and essential part of each sales contract for products and services provided by the Company to the Customer, unless otherwise provided in writing between the parties.

1.2. – The Company reserves the right to make any modifications and updates to these terms, which shall be deemed validly notified and shall take immediate effect from the day of publication on the internet website (hereinafter Website) where they can be found and reviewed by the Customer using ordinary diligence.

1.3. - They acquire full effectiveness between the parties and are understood to be unconditionally and fully accepted at the time the purchase order is placed, without such acceptance being conditioned by a handwritten signature by the Customer.

2.1 - Orders can be placed by telephone at the number +39 0922661191 or via the Internet, exclusively on the website www.musiczoneshop.it. Access to the service is permanent and continuous, except during maintenance periods, server update operations, and/or in the event of potential network service interruptions. The procedure implies the explicit acceptance of these GTCS, or through the signing of specific written agreements.

2.2 – Regarding the nature and date of the order, electronic mail messages shall serve as proof, as well as the automatic registration systems or contractual forms used on the Website.

2.3 – The Customer is responsible for the use of the credentials (UserID and Password) assigned to them at the time of registration, as well as for any orders requested using said codes, regardless of any fraudulent use thereof.

2.4 - The Customer is obliged to promptly communicate any change to the registered office or domicile indicated during the registration phase; failing this, notifications or communications carried out at the address indicated during registration will still be considered effectively and validly performed.

2.5 - Purchase orders are irrevocable; any requests from the Customer to modify an order will be taken into consideration exclusively if received by the Company, in writing, at least 24 hours prior to shipment and shall be deemed accepted exclusively through a new order confirmation.

2.6 - Any right of the Customer to damages or compensation is excluded, as well as any contractual or extra-contractual liability of the Company for direct or indirect damages potentially caused by the non-acceptance, even partial, of an order.

2.7 - After making the payment, the Customer will receive an email containing the information relating to the order. The processing times for confirming the receipt of payment are not fixed, and therefore the sending of the confirmation email may experience delays, for which Music Zone disclaims any liability as of now.

2.8 - Music Zone reserves the right to cancel or refuse any order received from a customer with whom a dispute is ongoing regarding the balance of a previous invoice.

The Purchase Contract shall be considered concluded between Music Zone and the Customer upon receipt of the Order by Music Zone. In this case, Music Zone will acknowledge receipt of the Order by sending an order confirmation email to the email address provided by the Customer. This Confirmation will summarize the Products selected by the customer, the relative Prices (including Delivery expenses), the delivery address, the order number, and the General Terms and Conditions of Sale provided therein.

The CUSTOMER undertakes to verify the correctness of the personal data contained therein and to promptly communicate any corrections to the seller.

Music Zone undertakes to describe and present the items sold on the website as accurately as possible. Nevertheless, some errors, inaccuracies, or minor differences between the website and the actual product may occur. Furthermore, the photographs of the products presented on the website do not constitute a contractual element, as they are for representative purposes only.

4.1 - The sale price indicated on the website is expressed in Euros and is considered inclusive of VAT, unless otherwise specified. The displayed prices do not include other accessory costs, which shall remain at the expense of the Customer, such as transport expenses, insurance, taxes, and any other accessory expense, of any kind or nature, not expressly indicated.
